Who Qualifies in WV?

West Virginia law allows expungement of many misdemeanors and some felonies. You must have completed your sentence (including parole/probation) and waited the required time:

May Qualify
  • Single misdemeanor — 90 days after completing an approved program
  • Multiple misdemeanors — 1 year after sentence completed
  • Nonviolent felonies — 3 years after sentence completed
  • Certain drug offenses under the WV Drug Offender Accountability and Treatment Act
  • Dismissed or acquitted charges
  • Arrests that did not lead to conviction

  • Violent felonies
  • Sex offenses
  • DUI convictions
  • Domestic violence convictions
  • Crimes against children
